Government permission to be taken before CBI probe, now Jharkhand CMO issued new order

The Jharkhand government on Thursday (November 5, 2020) issued an order withdrawing the consent given to the CBI to exercise powers and jurisdiction in the state. A statement from the Chief Minister’s Office (CMO) said that following the order issued by the state government in this regard, the Central Bureau of Investigation (CBI) will no longer have a consensus for the use of powers and jurisdiction in Jharkhand, which is the government of Jharkhand (then Bihar) under an order issued on 19 February 1996.

In recent times, the governments of Rajasthan, Chhattisgarh, West Bengal, Andhra Pradesh and Kerala also took similar decisions and withdrew the general consent given to the CBI. According to the new order of the Jharkhand government, now the CBI will have to seek the permission of the state government to investigate any case. This order will directly mean that now CBI will have to seek the permission of the Chief Minister in the state to investigate any matter or CBI can do so only by the order of the High Court and Supreme Court.

It is noteworthy that in the year 2018, the then Chandrababu Naidu government in Andhra withdrew from the NDA. The CBI’s entry into the state was banned this year. After this, the same order was passed by West Bengal CM Mamta Banerjee. In 2019, the Congress government of Chhattisgarh has withdrawn the general counsel given to the CBI for investigation in the state. After the revolt of Secretary Pilot in Rajasthan, the Ashok Gehlot government of the state has also withdrawn the general counsel from the CBI.

Let us tell you that CBI works under Delhi Special Police Establishment (DSPE) Act. Its Section 6 prohibits the investigating agency from conducting investigations in any state outside Delhi, including the Union Territory, without the permission of the government. (Agency input)
